A 20-year-old man who was convicted of raping of a teenage schoolmate but sentenced to only 45 days in jail and five years' probation must also undergo the standard probationary conditions, including evaluation for sex offender treatment, a Dallas district court judge ruled Thursday.
Sir Young pleaded guilty to the attack on a 14-year-old girl at a Dallas high school in 2011 when he was 18. Both Young and the girl testified during the trial last week that the girl said "no" and "stop" numerous times before and during the rape, according to the Dallas Morning News.
Judge Jeanine Howard, who sentenced Young last week, did not impose the standard probationary conditions. She said he was "not your typical sex offender" and questioned whether the girl had embellished her story.
Howard sentenced Young to 45 days in jail and 5 years' probation in which he was ordered to complete 250 hours of community service at a rape crisis center where volunteers work directly with victims, something that victims' advocates say is illogical. The 20-year-old had faced up to 20 years in prison.
The judge explained her sentencing decision to the Dallas Morning News, saying the 14-year-old girl "wasn't the victim she claimed to be." Howard also pointed to medical records that she said show the girl had three previous sexual partners and gave birth to a baby - which the girl's mother denies.
In 2012, Jose Arriaga Soto Jr. was accused of beating and raping a woman in East Grand Forks, Minnesota. He pleaded guilty and was found guilty of first-degree criminal sexual conduct. While a 12-year sentence was recommended, the judge on the case, Judge Jeffrey Remick, reduced it to 30 years of probation instead because Remick believed that Soto was a perfect candidate for remediation and counseling, according to the Minnesota Star Tribune. This sentence was particularly shocking given the violent nature of the crime. The assault lasted two hours and involved two men. The victim was strangled, bitten, repeatedly slapped, and received a number of other injuries. That was enough for the Minnesota Supreme Court to reexamine the case, which they did a year later.

A former Champaign police officer who pleaded guilty to committing an unwanted sex act with a former girlfriend in Piatt County has been sentenced to probation and jail time but will have to register for life as a sex offender.
Jerad Gale, 32, of Champaign, will spend four years on probation and six months in the Piatt County jail after pleading guilty Thursday afternoon before Piatt County Judge Tim Steadman to a single count of aggravated criminal sexual abuse.
He is expected to plead guilty to the same crimes in two Champaign County cases Friday morning for the same sentence, to be served concurrently.
Gale is to turn himself in at the Piatt County Jail June 3 to serve the full six months, minus 23 days he served when he was arrested 11 months ago.
