A death row inmate set to die by firing squad this week is asking the federal court to block the execution.
Attorneys for Ronnie Lee Gardner filed the request for a stay in Salt Lake City's U.S. District Court on Monday.
Gardner wants his execution stayed pending the court's consideration of a civil rights lawsuit he filed last week challenging the commutation hearing process of the Utah Board and Pardons and Parole.
The parole board denied Gardner's bid for clemency on Monday.
Gardner, who was convicted of capital murder and sentenced to death in 1985, is set for execution on Friday.
The Utah Supreme Court denied an appeal from the two-time convicted killer late Monday. The court says it's too late for Gardner to challenge his sentence.
