Judge says 3-year-olds don't need legal representation in court

A federal judge believes toddlers can defend themselves in court, according to his deposition in a court case seeking government-appointed attorneys for the youths.

"I've taught immigration law literally to 3-year-olds and 4-year-olds." Judge Jack Weil said. "They get it."

Senate Minority Leader Harry Reid of Nevada introduced legislation that would require the government to appoint attorneys for children in court who were victims of abuse, torture and other violence.

US Senate majority leader Harry Reid said he once saw a five-year-old girl “clutching a doll and so short she could barely see over the table to the microphone” summoned before a judge.

Experts responded to Weil’s comments with no small degree of shock. Temple University professor Laurence Steinberg told the Washington Post, “I nearly fell off my chair when I read that.”) A Justice Department spokesperson said Weil was “speaking in a personal capacity” and his statements “do not necessarily represent” the department’s views.

Weil did not respond to email or calls.

The due process clauses of the constitution (5th & 14th Amendments) apply as established in Wong Win v. United States (1896) and the Immigration and Nationality Act of 1965 (H.R. 2580; Pub.L. 89–236, 79 Stat. 911, enacted June 30, 1968) requires a “full and fair hearing” before an immigration judge.

I cannot imagine that a three-year-old child deprived of counsel in a legal proceeding is receiving a full and fair hearing.
