Judge: Law trimming early voting in Ohio is unconstitutional

A law trimming early voting in swing-state Ohio is unconstitutional and cannot be enforced, a federal judge ruled Tuesday.

The state's Democratic Party was among the plaintiffs who sued Ohio's elections chief over a series of Republican-backed voting changes.

Such policies included the elimination of a week of early voting in which Ohioans could also register to vote — a period known as golden week. Democrats alleged the change disproportionately burdened black voters. The state argued that the changes were minor and that Ohio residents had many opportunities to vote.

U.S. District Judge Michael Watson sided with Democrats on their golden-week claim, ruling that the cut violates the Voting Rights Act and voters' equal protection rights.

Watson said statistical and anecdotal evidence presented in the case reflects that black voters use same-day voter registration and early voting options at higher rates than whites. While the court can't predict how African-Americans will turn out in future elections, he said, "It is reasonable to conclude from this evidence that their right to vote will be modestly burdened" by the law.

Silliness.

More "race baiting" from the demokrauts? Why should any law be directed to serve any one ethnic group in a "free society"? Why should the "majority" be hindered by the voting habits of any minority? Why not pass one standard law....dedicating ONE DAY to vote....with "required" proof of why anyone of any ethnic group deserves....EARLY VOTING, ABSENTEE VOTING....the law should be standardized with exceptions closely monitored when any type of "hardship" voting is requested....such as early voting, absentee...etc., The burden of proof should be on the those requesting "special" treatment, NOT THE NORMAL MEMBERS OF SOCIETY that apparently has no problem getting out to vote on "ELECTION DAY".

Just like all other guaranteed rights....voting is no exception, the self governed PEOPLE as in WE THE are the only entities that can place regulations on THE RIGHT TO VOTE, not the self serving politicians who have a history of manipulating voter turnout by allowing special treatment to certain demographic voter blocks.

Just how is selling votes for government handouts any different than standing at the polling place passing out pints of liquor or 20 dollar bills? There is no difference. Voting for a "living" has been very profitable for both the career politician and the career WELFARE LEECH.

I believe a new amendment should be forthcoming. Only those with a valid W-2 form should be allowed to vote...if you do not contribute to the POT....you should not be allowed to vote yourself a share of the POT.

"But...if anyone does not provide for his own; and especially for those of his own household...he has denied the faith and is worse than an infidel." -- 1 Tim 5:8

"If anyone shall not work...neither shall he eat." -- 2 Thess. 3:10

Mankind is under a curse from God....commanded to work and earn his way in life from the ground he was taken from.(Gen. 3:17-19) There is no communism taught in scripture in relation to this life, as the priority should be directed toward the spiritual essence of mankind not the physical. "Do not labor for the food that perishes but for the food which endures to everlasting life." -- John 6:27.

In context Jesus was chastising those who were following Him because they had been fed from the miracle of the fish and loaves....they followed Him not because of the spiritual message He was teaching but to fill their bellies. Its the same principle with certain voter blocks...they vote democrat in spite of the history actual that demonstrates they were against every civil rights vote that came across their path....THEY VOTE TO FILL THEIR BELLIES at the expense of their souls. They quest after a physical kingdom....not the spiritual kingdom whose reward rests at the end of life.

Hopefully the 6th Circuit will over-turn this very bad decision.

The judge only found it unconstitutional because it supposedly effects more blacks than white people. If blacks were not effected more than whites the judged would not have ruled it unconstitutional. Seems like a racist decision. :dunno:

"If it was constitutional for lawmakers to expand the voting period to 35 days, it must also be constitutional for the same legislative body to amend the timeframe to 28 days, a timeframe that remains one of the most generous in the nation," Husted said in a written statement.

I think voters should have an opportunity to vote and if early voting gives them an opportunity, then it should be encouraged.

Voting isn't free.

It costs money and requires Capital to operate the polls, just a reminder.

States should have the right to set their voting procedures. When early voting was restricted by a week during our midterms
I noticed no difference in voting patterns

I have to wonder how much of a burden it is to drop a week of early voting, but I did see long lines in Az.
That looks to be the metric.
IOW it has to be shown long lines and delays would result to over-turn state purviews.

Judges also have a right to rule States voting procedures unconstitutional, it is our glorious system of checks and balances.
