But if past Justice Department practice is any guide, then the 2024 Republican candidate’s alleged obstruction may have been what put him over the line into criminal territory in the government’s eyes.

To illustrate the point, look at the situations of President Joe Biden and former Vice President Mike Pence. Both men also had classified material during the time Smith was probing Trump, and both of them apparently cooperated with the government rather than obstruct government efforts to retrieve the material. Pence isn't being charged, and there's reason to think the same will be true for Biden.

Not a "cover up". Rather, he acted as if he were above the law, effectively told the Justice Department to get lost. Figured he could play hide and seek with the documents without risk. If you're going go that high stakes, however, you can't be stupid and clumsy in your execution, not even if you're Trump.

Let me get this straight. You think Trump moving some boxes of declassified Presidential documents is obstruction but Hillary smashing iPhones and wiping hard drives isn't. Odd.:laugh:
 
It is the crime in this case. However, he made it all worse by refusing to return the documents he stole. It did not change the base crime of stealing a truckload of classified documents. However, his lying and obstruction added more charges.
 
It wouldn’t have mattered what Trump did, the left still would have went after him.

Hating Trump, which is not real, is not chargeable. I do not hate Trump. But I think he should face the courts for what he has done.
