Inadvertent viral-video star may sue mall


LMAO.... 'oh, I was texting while walking and I wasn't looking where I was going and I walked into a ledge and fell in water.... that HAS to be someone else's fault. They.... like... should have come out to help me. Because I stayed there at least a minute and then left.'

She is now going viral again as people are mocking the above interview. Nothing like proving to the world you are a moron a second time.

she can't win, she caused the harm and from the video she didn't look injured, maybe a bruise or two, but she high tailed it out of there and looked completely embarrassed

the mall does not owe a duty of care that extends to her not looking where she is going while texting...she has actually now compounded the embarrassment because, i don't about you, but i didn't know who she was until this came, nor did i care, so not only is a clumsy texter, she is an idiot
 
Sue the mall?? First of all it was her carelessness which contributed to the accident. Second, she was in a public place so anyone can see her actions.

This reminds me of an "accident" I had. I was walking down the sidewalk and noticed a gal on the third floor of a building, leaning on the window ledge with her hands, looking out. I looked up at her and she looked at me. I kept walking while looking at her and walked into a large planter which held a tree.

The planter was about three feet tall which abruptly stopped me. However, having been walking the force of motion caused the upper part of my body to lurch forward hitting my head on the trunk of the tree.

She laughed, I waved and carried on. Fortunately, there wasn't anyone else close by to witness the event. I never thought of suing her on the grounds of looking so good. :)

I am fairly certain most of us have had a moment such as the above. I know I have. We get pre-occupied with something and aren't paying attention to where we are going and BAM... instant embarrassment. Something our friends relish in when they witness said classic moments.

yurt is right.... no one would have known from that low quality video who it was had she not told everyone with this interview.

We should now place a warning label on all cell phones that reads:
TEXTING WHILE WALKING MAY LEAD TO EMBARASSMENT
and they should place a railing around all pools, combined with a 6 ft warning track.
