i am not so sure of that

was the glass broken before she shoved the woman

also, it does not seem to have the intent that would be required for manslaughter

she would probably have received attempted negligent homicide here but still possibly probation considering the lack of criminal record

Why would you push a wine glass into somebody's neck unless you wanted to injure them. As to whether it was broken or not beforehand it doesn't say.

i suspect that both women were under the influence of alcohol and the woman that shoved the wine glass may not have deliberately aimed for the neck or perhaps forgot that she had the glass in her hand

there is so much that the article does not address leaving questions for us to ask but not get answered

Yes, there is some merit in what you say. Although I can't help being pretty, blonde and middle class didn't hurt either.

especially if the judge was male - being young blond and pretty certainly helps i woman, but there can be a down side to it also, stalkers...
