We have every right, upon resuming power, to appoint as many justices as necessary to restore balance. They want to use their ridiculous unprecedented tactics to not even consider the pick of a president from the opposite party, then they want to shove their radical, fascist pick from a president who didn't even win the popular vote down our throats with the nuclear option. Well, let them have their nuclear option. We should use the extra nuclear option and settle this once and for all. And fuck them.
 
We don't have to live under 30 years of a new Lochner court just because Republicans got lucky and won the judicial selection lottery. The nation is split evenly between Republicans and Democrats, yet Republicans demand 7-8 of the nine justices. Ridiculous. We can expand the court to restore balance, and we should.

Conservatives are simply incapable of making good law, because the concept of justice is utterly foreign to them. Justice is about making an unfair world more fair, and rightists think the world already is utterly fair. They think the bullied deserve to be bullied, and that the oppressed deserve their oppression, and there's nothing wrong with that. They are incapable of comprehending justice, they are animals.

All the worst decisions in history have been conservative ones. Lochner. Dred Scott. Plessy vs. Ferguson. Tell me one good thing any conservative has ever done to make the law in the US more just.

Reality is dawning on you isn't it.

We could conceivably have a 7-2 Court.

Just need Kennedy to retire and Ginsberg and Breyer to croak. You should become their personal body guard. It would be horrible if Ginsberg died in her sleep
 
There is precedent for this. Abraham Lincoln expanded the court from 7 to 10 justices to drown out the awful Dred Scott era court. And since the Republicans seem intent on giving us many more Dred Scotts in the future, we have every right to use the precedent of Abraham Lincoln.

I didn't realize Lincoln expanded the court, I thought it was congress. If you want to talk court packing, see F. Roosevelt who basically tried to make the judicial branch worthless. He should have been impeached and tried for treason.

they could conceivably keep a justice alive for a very long time even if in a vegetative state. Is there precedent for forcing one of them out?
