Those who don’t know the first thing about the law immediately began hurling words like “obstruction of justice”, “high crimes and misdemeanors” and “impeachment“. Typically, these people don’t know what they don’t know.

Here is what we do know.

Under the law, Comey is required to immediately inform the Department of Justice of any attempt to obstruct justice by any person, even the President of the United States. Failure to do so would result in criminal charges against Comey. (18 USC 4 and 28 USC 1361) He would also, upon sufficient proof, lose his license to practice law.

So, if Comey believed Trump attempted to obstruct justice, did he comply with the law by reporting it to the DOJ? If not, it calls into question whether the events occurred as the Times reported it.

Obstruction requires what’s called “specific intent” to interfere with a criminal case. If Comey concluded, however, that Trump’s language was vague, ambiguous or elliptical, then he has no duty under the law to report it because it does not rise to the level of specific intent. Thus, no crime.

There is no evidence Comey ever alerted officials at the Justice Department, as he is duty-bound to do. Surely if he had, that incriminating information would have made its way to the public either by an indictment or, more likely, an investigation that could hardly be kept confidential in the intervening months.

Basically, in order for this memo to have any weight, it would have to have been immediately reported to the Department of Justice 3 months ago. And it wouldn't have been able to been leaked for a period of 3 months. In this current political climate.


 
the most hilarious thing for me is that the NYT mentions they did not read the actual memo and just had parts of it read to them :P
 
After reading about the threshold for this, I don't think Trump gets hit w/ obstruction of justice, and I don't think Comey thought it rose to that level.

It's just more amateur hour for Trump, more than anything.

This is one where the media and Dem politicians should just let it play out. The stories this week - the leak to the Russians, and Comey/Flynn - don't really rise at all to impeachable behavior. If Dems were in charge and I had anything to say about it, I'd remind them about '98.

Trump's errors carry their own ramifications with voters. If his opponents overplay their hand, they really risk creating both sympathy & backlash. He's doing a great, great job self-destructing on his own, and they should just clear out space to let him do it.

Kudos for not letting politics cloud your judgement on this.

Look I know Trump has flaws, and what I fear is that this climate all the hyperventilating will desensitize people to an actual scandal.

I don't know if they can help themselves. They think there is blood in the water. We will see if they can walk it back
 
btw anyone remember that there was a report earlier this year saying Israel stopped giving the US classified information? Yet they are claiming that the classified info is given by Israel now.

I wonder which report is truthful :D
