After stomping out of the budget talks like petulant 4-year olds because all their demands weren't met, Republicans are now freaking out over discussions of a plan to render their tantrums irrelevant using the Constitution - the document they selectively pretend to worship.



The proposal that Obama re-interpret Section 4 of the Fourteenth Amendment to justify raising the $14.3 trillion debt limit has been gaining traction in Democratic circles since Treasury Secretary Tim Geithner told reporters that the Constitution's language could support the president's raising the limit without congressional approval.


'The validity of the public debt of the United States, authorized by law, including debts incurred for the payments of pension and bounties for services in suppressing insurrection or rebellion' -- this is the important thing -- 'shall not be questioned,' " Geithner read during a discussion hosted by Politico.


Sen. Charles Schumer, D-N.Y., and others on Capitol Hill reportedly acknowledged that the idea is percolating, and had been presented to the president.


"It's certainly worth exploring. I think it needs a little more exploration and study," he said during a conference call with reporters held Friday.

It doesn't authorize the president to do whatever he wants to ensure the debts are paid. He can't violate the constitution to ensure that the constitution isn't violated.

With the US nearing a default on payments if Congress does not raise the debt ceiling, some analysts are suggesting President Obama invoke Amendment 14 to overrule the nation’s legislature.



The United States public debt is now almost US $200 billion over the limit imposed by Congress, according to the Web site US Debt Clock.Org.






The nation’s current debt is US $14.46 trillion, while the legally-imposed debt limit is US $14.28 trillion.




If the US Congress does not raise the debt limit, the country may lose its coveted AAA debt rating, while the shock to the economy could be catastrophic.




With negotiations stalling, legal experts have suggested President Obama over-ride the debt ceiling, calling the limit imposed by Congress unconstitutional.




Legal scholar Garrett Epps and fiscal expert Bruce Bartlett have both pointed out that the White House has the constitutional power to over-ride Congress.






“It's not hard to argue that the Constitution places both payments on the debt and payments owed to groups like Social Security recipients above the vagaries of politics,” Epps wrote.





Bartlett noted that, due to the global ramifications of a debt default by the United States, the debt ceiling could be seen as undermining national security.






Invoking the 14th Amendment to prevent default “is no less justified than using American military power to protect against an armed invasion without a congressional declaration of war”.




The legal and constitutional basis is section 4 of the 14th Amendment, which states, “The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned”.






President Obama has remained largely silent on the issue...

You people are beyond ignorant. The part of the constitution being used here, is being deliberately misinterpreted. It is designed so that a future Congress can't come in and say; No, we don't owe $14 trillion because this Congress never authorized the spending. It is NOT intended to be used to RAISE the debt limit. Read it carefully... the DEBT can't be questioned... but the DEBT LIMIT most certainly CAN!
 
the constitution SPECIFICALLY assigns the money/purse strings to congress, not the president. the president can't spend or borrow a penny without the express written approval of congress.

Does the government even need a debt ceiling?


Some analysts say no, and that Obama can simply order the Treasury to pay its bills even if Congress refuses to raise the debt ceiling.


"Preventing default is no less justified than using American military power to protect against an armed invasion without a congressional declaration of war," writes Bruce Bartlett in Fiscal Times.


Like others, Bartlett cites a section of the 14th amendment to the U.S. Constitution, which says "the validity of the public debt of the United States, authorized by law ... shall not be questioned."


"This could easily justify the sort of presidential action to avoid default that I am suggesting," Bartlett writes.


Garrett Epps, writing on The Atlantic's website, said Obama could give a speech saying he has ordered Treasury Secretary Timothy Geithner to "begin issuing binding debt instruments on the world market sufficient to cover all the current obligations of the United States government, even in default of Congressional action to meet those obligations."


Epps said the debt provision of the 14th amendment "makes clear that both the monies our nation owes to bondholders, and the sums promised in legislation to those receiving pensions set by law from the federal government, must be paid regardless of the political whims of the current congressional majority."


Obama declined to comment on the 14th amendment during last week's news conference, but Democratic lawmakers said they have discussed it.
