Carroll will claim trump is a public figure but so is she. She was a well-known magazine columnist for 15 years and had her own cable tv show in the 90s.

june 27 2023 Bloomberg) -- Donald Trump is doubling down on his legal brawl with E. Jean Carroll, suing the New York author for defamation weeks after a jury held him liable for sexually abusing her.

The former president on Tuesday night filed a counterclaim accusing Carroll of trashing his reputation by publicly accusing him of rape on CNN, despite jurors concluding his actions during the alleged 1996 assault hadn’t gone that far.

When Carroll was asked on CNN a day after the verdict about the jury finding that Trump didn’t rape her, she falsely claimed otherwise, according to the filing.

“Oh yes he did, oh yes he did,” she said, according to the filing, which says that Carroll made the comments “with an intent to significantly and spitefully harm and attack” the former president.

“The interview was on television, social media and multiple internet websites, with the intention of broadcasting and circulating these defamatory statements among a significant portion of the public,” Trump’s lawyers said in the filing.

Trump has filed about 100 civil suits since the 2000 election, and in almost 100 percent of the cases he lost or had his case thrown out as baseless.

Trump isn't going to win this and he is likely to drop it before it gets anywhere close to getting to court. If Trump follows through with the lawsuit then he will be required to give another deposition and testify in court as to his injuries. Trump isn't about to testify in open court.

The real problem is that just because Trump's sexual assault on Ms Carroll didn't meet the legal definition of rape in NY doesn't mean it wasn't rape under any other definition. OJ isn't going to be suing him for calling him a murderer after he was found not guilty because people are allowed to have opinions and use definitions that aren't legal ones. The truth is a defense against slander and libel.

Trump's lawyers may get lucky and avoid being reprimanded for filing a frivolous lawsuit.
