The Force is With Me
A confidential Justice Department memo concludes that the U.S. government can order the killing of American citizens if they are believed to be “senior operational leaders” of al-Qaida or “an associated force” -- even if there is no intelligence indicating they are engaged in an active plot to attack the U.S.

The 16-page memo, a copy of which was obtained by NBC News, provides new details about the legal reasoning behind one of the Obama administration’s most secretive and controversial polices: its dramatically increased use of drone strikes against al-Qaida suspects abroad, including those aimed at American citizens, such as the September 2011 strike in Yemen that killed alleged al-Qaida operatives Anwar al-Awlaki and Samir Khan. Both were U.S. citizens who had never been indicted by the U.S. government nor charged with any crimes.

The secrecy surrounding such strikes is fast emerging as a central issue in this week’s hearing of White House counterterrorism adviser John Brennan, a key architect of the drone campaign, to be CIA director. Brennan was the first administration official to publicly acknowledge drone strikes in a speech last year, calling them “consistent with the inherent right of self-defense.” In a separate talk at the Northwestern University Law School in March, Attorney General Eric Holder specifically endorsed the constitutionality of targeted killings of Americans, saying they could be justified if government officials determine the target poses “an imminent threat of violent attack.”

But the confidential Justice Department “white paper” introduces a more expansive definition of self-defense or imminent attack than described by Brennan or Holder in their public speeches. It refers, for example, to what it calls a “broader concept of imminence” than actual intelligence about any ongoing plot against the U.S. homeland.

“The condition that an operational leader present an ‘imminent’ threat of violent attack against the United States does not require the United States to have clear evidence that a specific attack on U.S. persons and interests will take place in the immediate future,” the memo states.

Instead, it says, an “informed, high-level” official of the U.S. government may determine that the targeted American has been “recently” involved in “activities” posing a threat of a violent attack and “there is no evidence suggesting that he has renounced or abandoned such activities.” The memo does not define “recently” or “activities.”

As in Holder’s speech, the confidential memo lays out a three-part test that would make targeted killings of American lawful: In addition to the suspect being an imminent threat, capture of the target must be “infeasible, and the strike must be conducted according to “law of war principles.” But the memo elaborates on some of these factors in ways that go beyond what the attorney general said publicly. For example, it states that U.S. officials may consider whether an attempted capture of a suspect would pose an “undue risk” to U.S. personnel involved in such an operation. If so, U.S. officials could determine that the capture operation of the targeted American would not be feasible, making it lawful for the U.S. government to order a killing instead, the memo concludes.

ALL rights that Americans once had to a fair trial to be judged by a jury of your peers has just been removed.

Geebus... What has happened to my nation? And it doesn't matter which of the major parties are in power they'll both be happy about this kind of power.

I afraid it DOES matter which of the major parties are in power....if this happened under a Republican, they alone would be held responsible...
It happens under a Democrat, and suddenly both parties are responsible....

All rights removed? Hardly, BAC. I so tire of your hyperbole and bitching about the President and his administration. You and your kind are the biggest dangers to America that I know of right now. Now go bananas in your own self righteous way on that!!!!!!!!!!

I don't see anything about this that would prevent this from justifying the assassinations of people active in the peace movement, to use one example. You have to be stupid to think they'd have any bother using any ole excuse as to why the activist posed undue danger to any agents sent to arrest them. Whoever they might be. This adminstration, the next...or ten adminstrations from now. What will this look like then? This is a very bad thing.

That is a million miles away from killing American citizens in a foreign country positively associated with known terrorists and absolutely planning to kill American troops and destroy American assets. I normally agree with a lot of what you say, Darla, but you're just wrong on this one, IMHO.

Well, given that there is no mechanism for evaluating the truth or falsity of the assertion that a person is an operational leader of al Qaeda or its affiliates, there is no functional difference between the two. You're relying exclusively on the good faith of government officials that is by no means warranted.

Then go stick your useless head in a toilet and the world, including me, won't bother you.

I'm sick and tired of weak ass partisans like you .. but that doesn't stop me from posting what I believe is the truth.

False equivalents. We have very limited investigative entities in these war zones and virtually no court rooms. I learned in Viet Nam that if I was being placed in danger by a stupidassed decision by a stupidassed squad/platoon leader there were ways to deal with him. If in the middle of enemy contact one of the troops went berserk and started firing crazily or crying and yelling we did everything possible to quell it as immediately as possible. Are you getting my drift? War is hell, my friend.

If there is one thing I've learned about you, BAC, is that your opinion and a box of rocks will not buy a cup of coffee. You really do make me sick with your own particular brand of personal partisanship. How does that toilet smell, freaky?

If the "white paper" limited the authority to war zones (or any area in which there are active hostilities for that matter), you'd have a point. It doesn't.

And forgive me if I think it inappropriate for the United States government to assassinate its citizens base on limited investigative entities and lack of judicial review.

Have you ever tried to apprehend a suspected war criminal in an identified terrorist state? Then you don't know what the fuck you're talking about. The United States has a very long and sometimes secret history of taking out traitors whenever and wherever we can find them. That's just a simple fact.

WHO GIVES A FUCK WHAT MAKES YOU SICK? Hopefully you have a puppy. It might care .. I don't.

Grow a brain and you actually might be able to debate what's posted instead of whining like a stuck pig about me.

You're a fucking partisan hack .. and Obama is God.

Post that stupid shit to someone else who might care.

(1) We're not talking about suspected war criminals.

(2) The authority is not limited to people located in terrorist states.

(3) Whether the United States has a history of doing something is not relevant to the question of whether it is an appropriate exercise of power or whether the activity is consitutional.

Also, too, I doubt very seriously that you have ever attempted to apprehend a suspected war criminal in an identified terrorist state (whatever that is).

Obviously you care a lot, dumbass. Obama is goD? I'm an Atheist. You are the one whining like a stuck pig. And I am that one that stuck you. Now, ain't that the shits?

Having been shot at and missed and shot at and hit I suppose I look at things a little differently than those that have only their inexperienced opinions to blather about.

Hey at least he isn't weatherboarding people and GITMO is closed.

Sure this bothers BAC because he is rare in that he is a principled left winger.

Gatorman isn't a surprise and folks like Darla and Dungheap and the others while not defending this the way Gator is will only offer up token opposition but have already forgotten about it.

This will e considered taking the bad with all the good Obama wants to do, so they won't squeal too loudly. Not like they would if this were a Republican.

No, if it were a republican, there would be cries of "WAR CRIMINAL" and threats of a trial at The Hague?

But this? No biggy
