Missouri: Extreme Anti-Gun Bill Disguised as “Protecting the Second Amendment Act”
The anti-gunners in Missouri have really outdone themselves with House Bill 2129. Sponsored by state Representative Joshua Peters (D-76) and cosponsored by state Representatives Randy Dunn (D-23), Stacey Newman (D-87), Sharon Pace (D-74) and Tommie Pierson (D-66), HB 2129 might be one of the most extreme gun control measures introduced in the Show Me State this legislative session.
The sponsor of HB 2129 tries to disguise this gun control bill by calling it the “Protecting the Second Amendment Act.” But don’t be fooled, the sponsor and cosponsors of this legislation have no regard for the Protection of the Second Amendment or your right to self-defense. As introduced, HB 2129 would prohibit a person residing in a city not within a county from possessing, manufacturing, transporting, repairing, or selling shotguns, short barreled rifles and “automatic handguns.” This would not only affect law-abiding citizens, but law enforcement as well. HB 2129 does not make any exceptions for law enforcement personnel. Therefore, those who serve and use shotguns as a means for defense would have to turn those firearms over to the agency to be sent to the FBI. Anyone who does not comply would be guilty of a felony.
HB 2129 does nothing but penalize law-abiding gun owners. If enacted, HB 2129 would require the metropolitan police department of a city not within a county to develop and institute a surrender process in which the firearms prohibited in HB 2129 may be surrendered to the metropolitan police department. The metropolitan police department of a city not within a county would then have to hand over all firearms surrendered to the Federal Bureau of Investigation (FBI).
It is fairly obvious that not much thought went into the drafting of HB 2129. Also, to deliberately mislabel it is as legislation “Protecting the Second Amendment” is both deceptive and disrespectful to the tens of thousands of law-abiding citizens who use shotguns for self-defense, sporting and hunting purposes. Under this legislation, owners of shotguns would have to turn these firearms over to law enforcement. Additionally, firearms dealers and repair shops would also have to turn shotguns over to law enforcement and these firearms would then be turned over to the FBI.
Short barreled rifle and “automatic handguns”: These firearms are covered under the National Firearms Act (NFA) and are heavily regulated under current federal law. Firearms covered under the NFA have a rigorous, expensive and time consuming process for being acquired. In order to legally acquire a NFA item, a purchaser must submit the appropriate paperwork to the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) where long wait times for approval are unfortunately common (six months or more). Also, purchasers must undergo a background check by the FBI, find a licensed dealer authorized to conduct the transaction and pay a one-time $200 federal tax for each device.
Don’t let the sponsors of this extreme gun control legislation fool you. HB 2129 does NOTHING to Protectthe Second Amendment, rather, it would erode the rights of law-abiding citizens in cities (not located within counties).
