The City of Dallas gave $1.1 million to Ronald Jones on Wednesday for his claims that he was beaten and falsely arrested by Dallas police — and then spent 15 months in jail as a result.

On December 18, 2009, Dallas police got a call of two white men fighting in downtown Dallas.

But then Dallas police Officer Matthew Antkowiak saw Jones — who is African-American — crossing Reunion Boulevard.

"Mr. Jones is walking down the street. Doesn't fit the description at all," said his attorney, Don Tittle.

The officer claimed Jones was throwing beer cans, so he pulled him over to arrest him.

"From there, he pulls one of Mr. Jones' arms up very aggressively and Mr. Jones turns around to see what is going on and why was he being placed under arrest, and from there it goes,” Tittle said.

The officer took Jones to the ground and hit him a few times. The two struggled as more officers arrived.

In his report, Officer Antkowiak stated that Jones "...took his right hand and grabbed the officer by his throat, choking him and lifting him off the ground."

In his official report, Officer Antkowiak also claimed that Jones "kicked him in the testicles and groin area, while still choking him."

Jones was arrested for aggravated assault of a police officer and spent 15 months in jail until his attorney started requesting the dash camera videos as evidence.

Two dash camera videos obtained by News 8 show multiple officers on top of Jones; one officer is seen kicking him several times.

Jones' attorney his the 62-year-old client was crying for help.

Take a closer look at the dash camera video; it's Antkowiak who is on top of Jones, choking him.

Jones' attorney says on the second dash camera video, the officer is asked to turn off the camera. Then the officers said they found a crack pipe and claimed Jones was intoxicated.

"Had the videos not surfaced, it's likely that Mr. Jones would have been convicted of this and served a very long prison sentence," Tittle said.

On the day Jones' case was set to go to trial, the district attorney dropped the charges.

Nearly two years after the incident, the police department finally opened internal affairs and criminal investigations into the officers involved in this incident.

Antkowiak resigned; the other officers were cleared. Chief David Brown told News 8 they could not find evidence of excessive force, and he said Antkowiak suffered a concussion during the struggle and had to be hospitalized.

Still — faced with the facts in the case — the city gave Jones more than a million dollars in his lawsuit against the officers.

Chief Brown stressed the city settled because focus groups told them they would lose the case.

One by one, five police officers took the witness stand at the Skokie courthouse late last month for what would typically be a routine hearing on whether evidence in a drug case was properly obtained.

But in a "Perry Mason" moment rarely seen inside an actual courtroom, the inquiry took a surprising turn when the suspect's lawyer played a police video that contradicted the sworn testimony of the five officers — three from Chicago and two from Glenview

All five officers were later stripped of their police powers and put on desk duty pending internal investigations. And the state's attorney's office is looking into possible criminal violations, according to spokeswoman Sally Daly.

"Obviously, this is very outrageous conduct," a transcript of the March 31 hearing quoted the judge, a former county prosecutor, as saying. "All officers lied on the stand today. ... All their testimony was a lie. So there's strong evidence it was conspiracy to lie in this case, for everyone to come up with the same lie. ... Many, many, many, many times they all lied."

All five are veteran officers. Glenview Officer Jim Horn declined to comment Monday, while the other four — Sgt. James Padar and Officers Vince Morgan and William Pruente, all assigned to narcotics for Chicago police, and Glenview Sgt. Theresa Urbanowski — could not be reached for comment.

Legal experts in Cook County differ on how much of a problem perjury by police officers represents.

"Police officers are just like anybody — just because they're wearing a badge and carrying a gun does not give them more credibility," said Cook County Public Defender Abishi Cunningham Jr., a former Chicago prosecutor, defense attorney and judge. "Some officers approach it as a game of cops and robbers," he said. "This is anything but a game."

"I've heard some police officers say in a social setting, 'If (the defendant's) going to lie to beat the case, why can't I lie too?'" Cunningham said.

But Pat Camden, spokesman for the Fraternal Order of Police, the union representing rank-and-file officers, said the overwhelming majority of officers are truthful.

"Obviously perjury isn't something that is condoned by the FOP or anybody in the Police Department," Camden said. "These are allegations, and an investigation is taking place."

County prosecutors said judges occasionally don't believe an officer's version of events, but it's rare for a cop to be called out for lying on the stand.

A University of Chicago law student in the late 1980s and early 1990s studied police perjury in the Cook County system, interviewing dozens of courtroom veterans as well as narcotics officers. Myron Orfield, now a University of Minnesota law professor, found that most police officers, judges and public defenders believed officers at least shaded the facts to support their arrest.

"Sometimes the officers were just lazy," Orfield said last week in an interview. "Sometimes they stretched things to get the bad guy."
