The Constitution does not say how many Supreme Court Justices there are supposed to be. If Republicans want to ignore tradition, then Democrats can too. A newly elected President Biden could nominate 10 new justices, which would be the majority of the 19 member court.

I am tired of Democrats always respecting the rules while Republicans break them.

This has happened 19 times in the past.

9 times the Senate was held by opposition
10 times the Senate was held by the same party as the WH.

In the 9 times where the Senate was held by the opposition 1 time (Grover Cleveland I think) got a justice voted in regardless. 8 times the vote did not confirm the nomination.

In the 10 times where the Senate was held by the same party 9 times the justice was confirmed by the Senate.

So, if we go by Tradition and Precedent...

Trump should nominate somebody and the Senate should Approve...

In each of the cases the President was in an election year or a lame duck... It still doesn't change the actual precedent.

Now, as far as how trump could have been more proactive:

- He should have implemented a national testing and contact tracing program.
