july 29 2018 CHARLOTTESVILLE — Outspoken white nationalist Christopher Cantwell was banned from Virginia for five years after pleading guilty to assaulting two anti-racist protesters at a torch-lit white nationalist march at the University of Virginia last summer.

Standing with his hands behind his back, the 37-year-old Cantwell told Albemarle County Circuit Judge Cheryl Higgins that he was guilty of two charges of assault when he pepper-sprayed Emily Gorcenski and Kristopher Goad on Aug. 11 at the base of the Thomas Jefferson statue in front of the Rotunda.

Originally indicted on charges of felony illegal use of gas, Cantwell’s counts were amended to misdemeanor assault as part of a plea agreement.

Undoubtedly this was built into his plea agreement. It is actually a rather odd bird legally in so much as the SCOTUS has ruled that privileges and immunities clause gives people the right to move freely but has never established that the federal courts have the power to enforce that, deferring to the individual states.

Frankly, I've never heard of someone being BANNED from a state. I'll assume it is true. Seems he might not want to GO back, wouldn't you think?

I live in Virginia and have heard of it once before. I have always wondered about the enforceability TBH. When I was coming up, a friend's dad whom I never met was banned from the state because of his history being the head of a local motorcycle gang back before I was born that was kind of one of those Sons of Anarchy crime type thing back in the day. When my friend/his son died, he had to get special permission from the court to re-enter for X number of hours to attend the funeral otherwise they were going to bury him out of state just so he could attend.
