President Donald Trump’s executive order ending the separation of asylum-seeking families at the southern border sets the stage for the same court fight that bedeviled the Obama administration when it tried to jail families together, legal experts said Wednesday.

A key part of the order directs Attorney General Jeff Sessions to ask a judge in California to modify a longstanding federal court settlement—known as the Flores agreement—to allow officials to detain migrant children with their families for the duration of their immigration proceedings.

The 1997 agreement, forged after two organizations filed a class-action lawsuit more than a decade earlier, bars the government from holding migrant children.

Sessions will be following in the footsteps of Obama officials who tried and failed to change the terms of that settlement.

A federal judge, Dolly M. Gee, scuttled the Obama team’s efforts to jail families together in 2015 when she ruled that doing so violated the agreement and said migrant children couldn’t be held more than 20 days.

Her decision was upheld the following year by the Ninth U.S. Circuit Court of Appeals.

Critics of Mr. Trump’s order said it is meaningless since the action it envisions is prohibited by the Flores deal. “What the president signed today is not a solution, as it leaves children indefinitely in detention and is a violation of the law,” said Sen. Jeanne Shaheen (D., N.H.).

Justice Department officials haven’t said how their attempts to persuade Judge Gee will differ from those of their DEMOCRAT predecessors.

“I don’t see how the outcome will be any different,” said Eric Columbus, who worked in the Justice and Homeland Security departments during the Obama administration. “The only way they could prevail would be by taking it up to the Supreme Court.”

Gene Hamilton, a counselor to Sessions, agreed Wednesday that the Flores settlement still stands, saying it is up to the courts or Congress to seek a permanent fix. “The simple fact of the matter is that Judge Gee has placed the executive branch in an untenable position,” Hamilton said.

I was not up to date on Flores, thanks for posting this. Lotsa interesting implications here, so I am doing some more research on this.
