Default Backflipping FBI Agent Who Accidentally Shot Man Charged With Assault

This nut belongs in prison but nothing will be done to him. The evidence will be "lost" and the victim will get a ton of taxpayer money and that will be the end of it.

june 12 2018 The backflipping FBI agent who accidentally shot a man in the leg at a Denver bar earlier this month was arrested Tuesday and faces charges of second-degree assault, according to Denver Sheriff Department records.

A spokesman for the Denver District Attorney’s office told HuffPost 29-year-old Chase Bishop turned himself in Tuesday morning. Bishop could face additional charges based on the results of a pending blood alcohol content analysis.

“We are filing this charge now rather than waiting until the BAC report is received, which we understand could take another week, because sufficient evidence has been presented to file it,” Denver District Attorney Beth McCann said in an emailed statement. “If an additional charge needs to be filed after further evidence is received, we can file those charges then.”

The guy did a back flip showing off at a dance or something, his firearm fell out of his holster and discharged. How is that assault? perhaps he should sue the firearm manufacturer.

"This nut belongs in prison but nothing will be done to him." TK
Persons that can't handle a gun safely shouldn't handle them at all.
And if his job at the FBI requires him to carry a gun, then they should either fire him (pun not intended) or find him a job to do that does not require him to be armed.
"nothing will be done to him." TK
NBC-TV News reported this evening that he turned himself in to Denver police today, & was charged with 2nd degree assault (when the gun fired it struck a bystander).

NBC added that he could face more charges, if alcohol was determined to be a factor.
"It should be obvious to anyone why conservatives and libertarians should be against Trump. He has no grounding in belief. No core philosophy. No morals. No loyalty. No curiosity. No empathy and no understanding. He demands personal loyalty and not loyalty to the nation. His only core belief is in his own superiority to everyone else. His only want is exercise more and more personal power." smb / purveyor of fact 18/03/18

I am big on gun safety, but uh, okay I don't know how to combine firearms safety and backflips. But I don't think it was assault. how bout if a guy fell down and it discharged, would that be assault? I wonder if it was a Sig Sauer?

I don’t know what he should be charged with but there definitely should be repercussions. What an idiot. I carry all the time. All the time. You have to be cognizant of what your doing. Don’t let partying get you hyped to that point. Backflip...hmph.. And the gun went off when he handled it (to pick it up), not when it hit the floor. You can almost see him panic and try to recover it too quickly...and was careless.

    PS
"The guy did a back flip showing off at a dance or something" m2
    That's nice.
He shouldn't be doing that with a loaded gun in his pants.
"his firearm fell out of his holster" m2
    "Holster"?
I wasn't aware there was a holster. It may simply have been tucked into his waistband.
    "and discharged." m2
Why was the firearm in Condition 0? Is he in a combat zone?
And if he is in a combat zone, why is he at a venue where beverage ethanol if flowing, doing a back-flip?
    "How is that assault?" m2

    assault (e-sôlt´) noun
    A violent physical attack.

    verb, intransitive
    To make an assault.

[Middle English assaut, from Old French, from Vulgar Latin *assaltus, variant of Latin assultus, from past participle of assilìre, to jump on. See assail.]
    - assault´er noun *

You think gunfire is neither violent nor physical? A man was shot. That is both violent & physical.
"perhaps he should sue the firearm manufacturer." m2
    For what?
    The gun performed as designed.

Why was the gun in Condition 0?
If the safety had been on, but discharged due to the physical shock of hitting the ground, the manufacturer might have some liability.
But when the back-flipping agent picked up the gun, he puts his finger inside the trigger guard; a known error which disciplined troops are trained to not do.

This perp. committed a string of errors, and is obviously not viable law enforcement material.

McDonalds is hiring. He should count himself lucky to find entry level / minimum wage employment there.

ref: Firearms / gun carry - mode of carry:
Condition 0 - A round is in the chamber, the hammer is cocked, and the safety is off.
Condition 1 - Also called "cocked and locked", this means that a round is in the chamber, the hammer is cocked, and the manual thumb safety is on.
Condition 2 - A round is in the chamber, the hammer is uncocked.
Condition 3 - There is no round in the chamber, the hammer is uncocked but a fully loaded magazine is inserted in the mag well.
Condition 4 - The chamber is empty, the hammer is uncocked and there is no magazine inserted in the mag well: source - Thorsen

    No.
    You are not.
You are either a bad liar, or a buffoon; possibly both.
"I wonder if it was a Sig Sauer?" m2
You have not been explicitly clear on why you think it would matter.

    But many Sigs are double-action.
But I've seen the video a few times, and it doesn't look to me like a double-action discharge. Ockham's Razor, I think it was a Condition 0 discharge, with his finger inside the trigger guard, where:

    a) it should never be unless he intends to launch lead, &

    b) where it PARTICULARLY should not have been, with the firearm ready to fire as it clearly was. He $#@!ed up !! The FBI doesn't need clowns like that. They should drop that guy like a bad habit!

If the conduct is reckless, this might give rise to mens rea.

    His conduct was definitely reckless.
