Supreme Court rules for employers in arbitration case

In a 5-4 decision Monday, the U.S. Supreme Court found that arbitration agreements for individualized proceedings must be enforced under the Federal Arbitration Act.
The action was brought by employees who sought to litigate Fair Labor Standards Act claims, and related state claims, through federal class actions, or collective actions. The parties argued that a “saving clause” in the law removes the mandate if the arbitration agreement violates another federal law, and the agreements in question violated the National Labor Relations Act.

The opinion consolidated three appeals, Epic Systems Corp v. Lewis, Ernst & Young v. Morris and National Labor Relations Board v. Murphy Oil USA.

Justice Neil Gorsuch wrote for the majority, finding that Congress has instructed that arbitration agreements written like the ones before the court must be enforced as written. The majority also found that nothing in the National Labor Relations Act suggested that Congress had the intention to displace the Arbitration Act.

“These rules exist for good reasons. Respect for Congress as drafter counsels against too easily finding irreconcilable conflicts in its work. More than that, respect for the separation of powers counsels restraint. Allowing judges to pick and choose between statutes risks transforming them from expounders of what the law is into policymakers choosing what the law should be,” the majority opinion reads. “Our rules aiming for harmony over conflict in statutory interpretation grow from an appreciation that it’s the job of Congress by legislation, not this Court by supposition, both to write the laws and to repeal them.”

Gorsuch was joined by Chief Justice John Roberts and Justices Anthony Kennedy and Samuel Alito. Justice Clarence Thomas wrote a concurrence, and Justice Ruth Bader Ginsburg authored a dissent, joined by Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan.

This is why I love gorsuch and people like him. He just enforces the law as written. If it leads to a undesirable outcome he just says that congress should write better laws.

I prefer the stability this brings to the liberal way of interpreting random things that are not in the law itself. On one case I may be able to use it but it can get used against me in the next.

At least with Gorsuch your 100% sure what the law is and how it will be applied.

California Gov. Jerry Brown (D) spoke at a transportation conference at Los Angeles' Union Station. During his speech, Brown discussed the state's vehicle fee and gas tax increase and Republicans' attempt at repeal the additional taxes.

Brown plans to defeat the GOP's November ballot initiative that would end the fee and tax increases, something the governor sees as “devious, deceptive, unfair and un-Californian."

Less than a week after Stefan Halper was outed as the FBI informant who infiltrated the Trump campaign, public records reveal that the 73-year-old Oxford University professor and former U.S. government official was paid handsomely by the Obama administration starting in 2012.

A longtime CIA and FBI asset who once reportedly ran a spy-operation on the Jimmy Carter administration, Halper was enlisted by the FBI to spy on several Trump campaign aides during the 2016 U.S. election.

Meanwhile, a search of public records reveals that between 2012 and 2018, Halper received a total of $1,058,161 from the Department of Defense .

Halper’s contracts were funded through four annual awards paid directly out of the Pentagon’s Office of Net Assessment (ONA).

According to the Website USASPENDING.gov, the payments to Halper are for “RESEARCH AND DEVELOPMENT IN THE SOCIAL SCIENCES AND HUMANITIES (2012),” “RESEARCH AND STUDIES – THE YEAR 2030, (2014)”, “RUSSIA-CHINA RELATIONSHIP STUDY. (2015),” and “INDIA AND CHINA ECON STUDY (2016).”

The most recent award to Halper for $411,575 was made in two payments, and had a start date of September 26, 2016 – three days after a September 23 Yahoo! News article by Michael Isikoff about Trump adver Carter Page, which used information fed to Isikoff by “pissgate” dossier creator Christopher Steele . The FBI would use the Yahoo! article along with the unverified “pissgate” dossier as supporting evidence in an FISA warrant application for Page.

Hillary Clinton delivered her first official message to the DEMOCRAT National Convention since losing the Presidential election in 2016, and she had only one message for the gathered, mostly female, officials: you're not getting rid of me.

In what sounded more like a threat than an announcement, Clinton told the DEMOCRAT Women's Leadership Forum that she's going to be a foundational part of the anti-Trump "resistance," whether the "resistance" wants her or not.

The DNC is treating Clinton as an invaluable resource, paying her and her former campaign hundreds of thousands for "lists" and voter information repositories that weren't particularly useful to Clinton's own campaign. They're afraid of alienating her, no doubt, because she remains a powerful connection to high-dollar donors. In return, she's an albatross around their neck: a font of bad advice, bad optics, and bad luck.

But she's sticking around.

Rep. Keith Ellison (D., Minn.), the deputy chair of the DEMOCRAT National Committee, has not given any contributions to DEMOCRAT candidates from any of his own committees for the midterm elections, filings show.

Ellison's leadership PAC, the Everybody Counts Everybody Matters PAC, has posted lackluster fundraising figures this cycle.

Ellison's campaign committee, Ellison for Congress, has raised $2.3 million so far this cycle but also did not report any direct contributions to DEMOCRAT campaigns.
