    The 5th circuit ruling has no binding effect on the 9th circuit.

    I realize that but he's not even a 9th circuit judge he's a district judge and he completely ignored the stare decicis of the 5th circuit.

    Study up on federal jurisdiction, you don’t know what you are talking about.

    A district judge IN the 9th is not bound to follow a ruling from the 5th. No issue of SD here.

    This DACA ruling will get overturned at the S.Ct., where the standard is different.

    Jarod corrected you on this. But to make it more clear, stare decisis applies only in one's home town, if you will. A justice in one circuit has no stare decicis opinion power over another district. Only SCOTUS has this power. And SCOTUS rules the land, including states, whereas not all federal lower courts do.

    he is a district judge in the 9th Circuit......but still subject to appeals court decisions from any Circuit.....
