A missed deadline at the California Department of Justice is leaving some stores with a tough choice: close their doors or keep selling ammo while breaking the law.
Ammunition vendor licenses are a new requirement starting Jan. 1, 2018 for stores that sell ammunition.
The licenses are supposed to be issued by the California Department of Justice. The CA DOJ said last week the licenses would be issued by the deadline, however that didn’t happen.
When Foothill Ammo owner Chris Puehse opens his Cameron Park store Tuesday, he’ll likely be breaking the law. “I did all my paper work. I paid the fees. They’ve had time to figure this out. This is not my problem,” Puehse said.
However Craig Deluz, who works for the Firearms Policy Coalition, said the missed deadline will force other stores to close. To his knowledge, none of the roughly 230 stores that applied for licenses have been issued them.
“Unless the California Department of Justice basically says we’re not going to enforce the law, they really don’t have a choice,” Deluz said.
One person who won’t be enforcing the law is the El Dorado County sheriff, who doesn’t believe store owners should have to pay for the state’s tardiness.
“That’s unacceptable, that’s harm to them, I can’t enforce it, nor will I allow the state to come in and enforce it when it’s unenforceable at this time,” Sheriff John D'agostini said.
Puehse’s reasoning is more personal -- he can’t afford to close. “I have a family to feed, I have a mortgage to pay, I got a lease on my store, I got to stay in business,” Puehse said.

The Beholden States' DEMOCRATS had a backup plan in case their Prop 63 requirement didn't pass, too.
1. All ammunition sales to individuals are required to be face to face and shall require a background check. A long list of occupational exceptions, exceptions for concealed carry permit holders, law enforcement, etc. will not be required to process the background check, but sales will be recorded. Vendors may charge a fee of up to $10 per background check.
2. It will be illegal to purchase ammunition through the mail.
3. It will be illegal for residents of California to purchase ammunition out of state, and bring it back into the state. Ammunition purchased outside the state will be required to be sent to a licensed vendor in California.
4. Non-residents may legally transport ammunition into and through California, but may not sell it in California, unless is is sold through a licensed vendor subject to a background check. There are exceptions for sale to a direct family member, registered domestic partner, or hunting partner in quantities of no more than 50 rounds per month.
5. All ammunition sales will be kept on a computer data base that will be checked against a list of people who have been ruled to be prohibited possessors of firearms.
6. Nearly all private transfers of ammunition within the state of Callifornia will be required to be done through a licensed ammunition vendor, who may charge a fee for the process.

It's a great trick for subverting the Second without calling a constitutional convention and repealing it like Michael "Man Mountain" Moore wants to do.
Step 1: Pass a law that say you can't sell ammo without a license.
2. Step 2: Make it illegal to go to another state to buy ammo.
3. Step 3: Collect the fees for the licenses, and then simply don't issue any.
Soon, anyone who obeys the law will have no ammo. Their guns will be paperweights.
The NRA is calling this shoddy trick into question.

Starting July 2019, another layer of oversight kicks in: Anyone buying ammunition from a vendor will be required to undergo background screening via a state system.
