You know what the article purposely left out? Insurance. Typically, licensed businesses must carry insurance, or they cannot be licensed.

When the kid down the block drops your brand new flat screen, what recourse do you have?

Insurance is separate to having to get a license to legally do something.

A business can have insurance yet not be licensed

But the converse is not true. So your first sentence is blatantly false.

In many instances, the reason for licensing is to guarantee insurance. So what would you do when the kid down the block drops your brand new flat screen?

I work in real estate. To get my real estate license has nothing to do with insurance. So no, my statement is not blatantly false

There are 12 states that require realtors to have errors and omissions insurance. If you are involved in selling, as opposed to rentals, you could be sued. So if your neighbor hangs a shingle out to let everyone know he's showing properties...without a license...you have no problem with that?

You legally need to work for a broker to sell real estate but you individually need to have your real estate sales license (or have the brokers license yourself.

    It's not about insurance

So you have no problem with your neighbor showing properties illegally?

It is about insurance in 12 states, and for all intelligent brokers no matter the state.

One could set up shop, have insurance and not be licensed.

Not sure why you are trying to derail the subject

You are correct. Licences are less about protections for the consumer and more about revenue. There are even laws on the books that provide more protections to people like contractors than their customers.

When we lived in NC our roof was damaged in a hurricane. Filed an insurance claim and hired a licenced contractor. I told my wife not to give them a cent until there are materials on the ground. But she didn't listen (I was out of state for work) 6 months later he still hadn't shown up and wouldn't answer our calls. Filed with small claims. Our case was denied cause it had only been six months. The law gives them 36 months from the time initial payment is received till they have to start work. They then have virtually unlimited time till the job has to be completed.
