    Default Healthcare Decision Thursday: Prediction Thread

    So we're getting a decision on the Affordable Care Act on Thursday. Thought I'd make this the official prediction thread. My prediction is that, regardless of the outcome, unless Scalia writes the opinion of the Court, he will either write a concurrence or dissent (depending on the outcome) and will use the broccoli mandate example.

    Mandate cut out. (Ill be happy about that) (Mandate that was origionally proposed by Harry Truman, and fought for by Richard Nixon and Newt Gingrich)
    Several small other portions cut out. (Depends on what I might be happy)
    Majority of the Bill left intact.

    After the November Elections a Public Option will be installed filling the hole left by the mandate.

    mandate is righeously dead ( allah be praised), because it relies on a hyperextension interpretation of the Commerce Cllause.

    I don't know how much is severable; maybe preconditions,,not even sure about that. While I want universal access, i DON'T want it by hyperextension of the Commerce Clause -use Congressional powers to tax!!

    The best thing that could happen is tom trash this, and write a law that relies on enumerated powers.
    The ICClause leads to such horrors as Gonzalez v Raich which is the basis to allow Obama 's war on medical marijuana.

    It will be overturned, Obama will be re-elected with a majority, a one payer system will be implemented and the wails of Republicans will mimic a wounded bansshee.

    I predict that corporations will win and the American people will lose.

    Even if the SC changes nothing .. corporations win, Americans lose.

    If the SC strips out the mandate .. corporations win, Americans lose.

    If they overturn the entire law .. corporations win, Americans lose.

    Medicare for All is and always has been the best solution from the beginning.

    FDR had a better healthcare plan, too. In fact, there are quite a few presidents that had better healthcare plans, but they all had the same problem.

    I agree with you.

    The problem their plans had was that they were focused on the American people, not the corporate interest first and foremost .. and none of them had the momentum that Obama had. The American people were demanding it in 2008 .. so much so that even the republicans had to produce a plan of their own.

    That sums up the current state of things very well.

    As for the healthcare plan, I don't really think it would be a bad thing if it was overturned. I'm of the opinion that it is pretty flawed.

    What specifically do you think is flawed about it? I don't think it is by any means perfect, but I think it would be a quite bad if it were overturned in its entirety. If only the mandate were overturned it would be bad, too, but something would have to be done to fix it because health insurance costs would increase substantially or health insurers would go broke.

    Because Obama pushed it thru "by all means possible", nevermind the corporate influence", the real deal is he didn't want to be accused of raising taxes.
    So he relies on the Commerce Clause, as the mandate, because he doesn't have to cal it a tax.

    I warned everyone this is gonna come back and bite them, but no.."pass it now / pass it now" -well when you pass gas, it stinks, and you rid yourself of it by flushing the CRAP down the toilet. This was CRAP legislation, and it deserves flushing.

    Well, it's more like what he's trying to do for the world which includes everyone.

    Medical care for US citizens. Getting the troops out of the ME. Turning his attention to renewable resources.

    It's refreshing to see the leader of the free world thinking about the world. Doing things to help everyone. Dropping the saber rattling approach. If he has to do something, like get Osama, he does it. He doesn't go on TV shooting off his mouth about how strong he is.

    It's his whole approach. I suppose the word "civilized" sums it up best.
