I checked the link. In it there is another link stating the HIG is not operational yet. Anyway, assuming it is operational or does become operational how is it supposed to operate?

For example, if a person is apprehended the interrogation would be started immediately. Who decides if the person is a terrorist or just a crackpot? If one is designated a terrorist and it's later concluded they were just a crackpot (suicidal, anarchist) that will mean the person's rights were grossly violated. Have not cases been thrown out due to one not being read their Miranda Rights?

Furthermore, would the case against a run-of-the-mill crackpot be thrown out of court even if they had tried to bring down a plane? If memory serves correctly something happened not long ago where a passenger tried to open the door on a plane and was subdued. In that case the person was hospitalized and, so far, not considered a terrorist.

So, my point is what will happen if "Joe" is considered a terrorist and later found out not to be a terrorist? Will the authorities have to choose between lying and maintaining Joe is a terrorist, knowing if they go to criminal court his case will be thrown out due to his rights having been grossly violated, or let Joe walk free?

Does anyone see any potential problem here?
