Congress has that right under law as a watchdog over what the executive branch is doing. Checks and balances. What the FBI is doing is avoiding their legal duty by a weak equivocation.

It isn't a choice. The agency is legally required to cough them up, like it or not. The agency can't say "No, we won't give them to you." Government employees, likewise, have no choice but to appear.

The only out is the Lois Learner route. Resign or retire to avoid the subpoena and then take the 5th.
