Thread: In America, you have to opt out of religion in public life. That’s backward.

    Default In America, you have to opt out of religion in public life. That’s backward.

    In January, Americans United for Separation of Church and State and the National Women’s Law Center filed suit in Missouri, arguing that the state’s extreme abortion ban imposes a narrow religious belief on everyone else. Indeed, lawmakers had cited religion as motivation for restricting the reproductive choices of the people of Missouri, and the law itself refers to “Almighty God” as “the author of life.”

    It’s right there in the establishment clause of the First Amendment. But as long as this country’s default setting is religious — both culturally and politically — we have to fight for it.

    The First Amendment only refers to establishment of a state church, like the Church of England. It wasn't meant to exclude religion from either the public square or government entirely. Passing a bill that in part is inspired by religious principles isn't something banned by the Constitution.

    The 1st amendment, which applies only to Congress (in other words, the federal government), prohibits Congress from passing any law establishing a state religion, or from banning any religion.
    States, on the other hand, DO have that authority IF it is included in their own constitutions (like it once was for several States).

    Today, all of the States have amended their constitutions to more closely align themselves with the principles set out in the 1st amendment concerning religion.

    You are correct. Passing a bill inspired by religious principles is NOT banned by the Constitution. Neither is acknowledging a religious holiday displaying a religious symbol. NONE of that is establishing a state religion.
