If an employee takes the fifth when asked for evidence of expenses, you can and often do fire them. Criminally, you are innocent until proven guilty. In employment, you often have to prove yourself innocent.
In civil cases, it is based on the preponderance of the evidence. Usually, there are two sides in a civil case, and one of them is going to lose. So whichever side has 51% of the evidence wins. Unlike the 99% of the evidence you need in a criminal case. You can take the Fifth in a civil case, but that is going to hurt your case.
