    I agree that he is guilty, but I see evidentiary issues with hearsay and free speech, based on the evidence I know about.

    It’s not illegal to give a political speech, so if the evidence is based on that, there are some difficulties prosecuting.

    As far as I remember, the House Select Committee rarely even mentioned the speech.

    He called a rally at the exact same time that a joint congress was certifying the electoral vote count. The rally was right down the street, Think that was a coincidence. he organized the speakers and controlled the messaging. Trump was responsible.

    Who was the rally for? Trump knew the Capitol building was closed. All of Congress was inside, in session.

    That was the point. He wanted to stop the counting of electoral votes. He delayed it by several hours. If they got Pence into that car, it would likely not have happened.

    He and other speakers urged violence. That is illegal. there are limitations to free speech.

    Garland thought it was the right thing to do, but legal experts I've listened to think it was not needed. Even though there's a Special Prosecutor, it's Garland, ultimately who will have to decide whether or not to indict and sign off on it. So the appearance of impartiality goes away anyway.

    Also, it was brought up how unfair the treatment is trump is getting. If it were any of us, we'd be in jail right now and charged for Mar-a-Lago alone. twump gets 2 years to return the stuff, a Special Master and a Special Prosecutor. It's a bad look for Garland. And for our system of justice.
