    Default The Supreme Court punts on religious liberty

    The court’s 6-to-3 conservative majority disagreed, insisting that Kennedy’s act of praying was protected by the First Amendment.

    This decision was a mistake — not because public schools should be devoid of any religious expression but because students should not feel pressure from their teachers, administrators or coaches either to be or not to be religious, let alone subscribe to a particular faith.

    The irony of the decision is that it reduces religion to formal rituals. Being forced or intimidated to participate in a religion ritual, for the Court, is innocuous.

    Years ago the Court said it was okay to have an official prayer to open a session of Congress. They called it "ceremonial."

    Justice Neil M. Gorsuch’s opinion for the majority pretended that a coach’s prayer right after a game was an entirely private action — “he offered his prayers quietly while his students were otherwise occupied,” Gorsuch wrote — when, in fact, it was a highly public display.

    The school district said Kennedy defied instructions to stop praying alongside his players and made media appearances that turned his prayers into spectacles. The district said that some students felt pressured into taking part and that it offered alternative, less public places to pray after games

    He wasn't praying "privately" -- he was having a very public prayer huddle in the middle of the field with his team around him. On school property. Nothing would have been said if he'd done his praying out of the public eye. The school even offered him a place to do so, but he wanted to make a public spectacle of it.

    But Jesus did tell his followers not to pray in public.
