It's true that Harris failed the bar exam on her first attempt, per The New York Times. She later passed.

The bar exam is the qualifying examination for lawyers to receive a license to practice law in a given state.

California has a notoriously difficult bar exam. In 1985, the Los Angeles Times wrote that its pass rate "has generally hovered around 50%."

Harris graduated from the University of California, Hastings College of the Law in 1989.

Even now, the pass rate on the California Bar Examination averages out to approximately 50%.

oddly enough there is no requirement for any sort of legal certification to sit on the bench. That development (bar associations) came later in our history. anyone at all can be appointed.

of course it was assumed that the justice would actually be using the Constitution as the basis for their opinions which didnt last long.

You idiots should understand, it is not easy to pass the Bar Exam despite rigorous college training as many did not pass it at the first try but with further preparations passed it on the second sitting such as former Attorney General of California and Senator and now Vice President Kamala Harris. Actually, I would not expect to pass this exam on the first try either at having an MBA degree:
