It has been 58 years since the U.S. Supreme Court adopted the "actual malice" standard in the landmark decision called New York Times v. Sullivan, which made it difficult for public figures to win libel lawsuits.
Don Herzog, a University of Michigan law professor, said Palin would have trouble showing that the Times "subjectively doubted or disbelieved" the truth of what it presented as fact.

This is news?
Okay...well, I will wait for the court's decision.
And then I will probably barely care no matter what they decide.

This is very interesting to me, from my understanding, from the little bit I’ve read about the case, The evidence is that the New York Times made a mistake, and retracted it as soon as they were made aware of it. The law is that a simple mistake is not actionable, Sarah Palin must prove malice on the part of the New York Times, and I think that is going to be a very difficult burden for her based on these facts
