One of the most frustrating aspects of the January 6 committee’s attempt to find out exactly what Donald Trump was doing before, during, and after the the attack on the U.S. Capitol is the ex-president’s use of the court system to delay, delay, delay, and delay some more. In fact, at one point over the last few months, it actually felt like congressional investigators might never get their hands on the information they need to piece together what Trump was up to on that awful day, because his lawyers would just file appeals over and over and over again. But on Wednesday, all that changed when the Supreme Court near unanimously informed Trump’s legal team that its effort to cover up its client’s actions is over.
The devastating blow, in which every justice but Clarence Thomas agreed the presidential documents sought by the January 6 committee must be handed over, will give investigators an unfettered look at Trump’s activities surrounding the failed coup. As the Associated Press notes, there isn’t a single legal action Trump can take to stop the transmission of the documents, which has got to hurt. The information, which the panel has already reportedly begun to receive, includes visitor logs, presidential diaries, speech drafts, and handwritten notes. In addition to being a huge blow to his attempt to hide the role he played in the insurrection, the decision from the Supreme Court has no doubt made Trump extra apoplectic, given that he personally installed three justices—including one in the midst of the pandemic, less than two months before the election—in the hopes of having some friendly faces on the bench.
In a statement that can only be described as the congressional equivalent of fighting words, the January 6 committee tweeted Wednesday: “The Supreme Court’s action tonight is a victory for the rule of law & American democracy. The Select Committee has already begun to receive records that the former President had hoped to keep hidden & we look forward to additional productions regarding this important information.” Committee member Zoe Lofgren told CNN’s Erin Burnett that the court ruling is a “very big deal for getting the truth out,” adding: “We are going to get these documents and we are going to go through them and help piece this picture together.”
One thing said documents might help investigators out with? The “secret” meetings Trump apparently took in the lead-up to the insurrection. Per The Guardian:
The former White House press secretary Stephanie Grisham told the House select committee investigating the Capitol attack that Donald Trump hosted secret meetings in the White House residence in days before 6 January, according to two sources familiar with the matter. The former senior Trump aide also told House investigators that the details of whether Trump actually intended to march to the Capitol after his speech at the Ellipse rally would be memorialized in documents provided to the US Secret Service, the sources said.
The secret meetings were apparently known by only a small number of aides, the sources said. Grisham recounted that they were mostly scheduled by Trump’s chief of staff, Mark Meadows, and that the former chief usher, Timothy Harleth, would wave participants upstairs, the sources said…. Over the course of her hours-long interview, Grisham told House investigators that the mystery surrounding Trump’s promise at the Ellipse rally that he would march with his supporters to the Capitol might be resolved in Trump White House documents, the sources said.
While Trump never ended up going to the Capitol, investigators are still keenly interested in the promise he made to go, and whether he did that in the hopes of inciting the insurrection. According to Grisham, Trump’s intentions would be noted in the “presidential line-by-line,” a document that outlines the president’s movements. As The Guardian notes, that document “could also reveal discussions about security concerns and suggest a new line of inquiry into why an assessment about conditions that were too dangerous for the president were not disseminated further.” All of which sounds pretty bad!
Meanwhile, if you’re wondering if all this could end in criminal charges for Trump…it can! While the House panel itself does not have the authority to levy criminal charges, as The New York Times reported earlier this month, it can “provide the Justice Department with evidence of any wrongdoing it unearths in its investigation” and make a criminal referral. For example, following a criminal referral for contempt of Congress last fall, the Justice Department chose to criminally indict Stephen Bannon, with charges that could add up to two years in prison. According to the Times, “investigators are looking into whether a range of crimes were committed” in connection with January 6, including if Trump obstructed Congress in his attempt to stop the certification of Joe Biden’s win and “dereliction of duty” for doing nothing to stop the violence until hours after the fact.
