So do you think the S.Ct will allow the states to set any limit they want... like for example "at conception" or even pre-conception meaning they could legally ban birth control...?

I'm interested in seeing what happens, really.
I agree. But what new limit could be less arbitrary than viability? One of the arguments against Roe is that viability is arbitrary.

No he doesn't. He doesn't know what the definition of viability is. If he did, he would obviously not be stupid enough to believe.....

If the right of a woman to have an abortion is protected by the Constitution, then any law that has the practical effect of denying women an abortion would be unconstitutional. At a certain point, lowering the limit would have that practical effect. Because by the time the gestation period can be accurately identified, a low enough limit would make abortions impossible.

I would hope they would use brain activity, the same measure we use to determine when you are no longer a person should be used to determine when you become a person.

Viability will continue to happen earlier and earlier in pregnancy as we get better at ex utero incubation.
Excellence is an art won by training and habituation. We do not act rightly because we have virtue or excellence, but rather we have those because we have acted rightly. We are what we repeatedly do. Excellence, then, is not an act but a habit.
    - -- Aristotle

Believe nothing on the faith of traditions, even though they have been held in honor for many generations and in diverse places. Do not believe a thing because many people speak of it. Do not believe on the faith of the sages of the past. Do not believe what you yourself have imagined, persuading yourself that a God inspires you. Believe nothing on the sole authority of your masters and priests. After examination, believe what you yourself have tested and found to be reasonable, and conform your conduct thereto.

It is the mark of an educated mind to be able to entertain a thought without accepting it.

But that would mean that leftists everywhere would be declared nonviable.
