    essential component of comprehensive, affordable, confidential, and equitable family
    planning, reproductive, sexual health, and maternal health services.

    Title 42 has not only had a severely negative effect on asylum seekers, it has also led to an increase in the number of people crossing the border more than once, an effect acknowledged by DHS officials. Almost immediately after lockdowns lifted across Mexico and Central America, the number of single adults coming to the border seeking to enter the United States began rising rapidly, from a low of 14,754 in April 2020 to 62,041 in December 2020. Under Title 42, single adults are rapidly processed at the border and sent right back to Mexico without a deportation order. This arrangement has incentivized repeated attempted crossings, and the rate at which people crossed the border multiple times rose from 7% in March 2020 to 40% by October 2020. This increase in repeat attempts was also driven by people’s inability to obtain safety while waiting at the border for the United States to begin accepting asylum requests again, and the growing backlog of people waiting for the resumption of humanitarian processing at the border.

    The phenomenon of increased repeat crossings under Title 42 has created a distorted picture of the total number of people crossing the border. Through the first nine months of FY 2021, when CBP recorded a total of 1,119,204 border encounters, the number of “unique encounters” (people who have not been taken into custody in the previous 12 months) was 690,718 . By comparison, over the same period in FY 2019, CBP recorded 780,479 border encounters, of which 721,328 were unique encounters—over 30,000 more than in FY 2021.

    Thus, even though there have been nearly 340,000 more border encounters in FY 2021 than during the same period in FY 2019, fewer people have newly come to the border than two years earlier (see Figure 3).


    The Biden Administration Continues To Expel Most People
    The Biden administration continues to rapidly expel most people encountered at the border. In the first five full months of the Biden administration, 64% of all people encountered by the Border Patrol were expelled under Title 42 (see Figure 5). While unaccompanied children and some families at the border have been allowed to come into the country and challenge their deportation in immigration court, they represent just 28% of total apprehensions over that period.

    As a result, significantly fewer people are being admitted into the United States and placed into normal deportation proceedings when compared to 2019, even when considering the increased numbers of single adults and a record number of unaccompanied children crossing the border (see Figure 6). If the Biden administration continues the practice of expelling most people arriving at the border, apprehension numbers will increase above 2019 levels even though significantly fewer people are being processed into the country.

    However, DHS is unable to expel most families in part because of a change in Mexican policy, not U.S. policy. Due to a Mexican law passed last year, the Mexican government has refused to accept the expulsion of some families, especially in the state of Tamaulipas which borders the Rio Grande Valley.

    The Biden administration has tried to circumvent this change by flying some families or single adults apprehended in Texas to other places along the border and expelling them there. Families expelled this way describe feeling “tricked” by Border Patrol agents who told them they would be released, only to discover at the last second that they were being sent back to Mexico. In April, ICE flew 60 flights from South Texas to either El Paso or San Diego, with at least 100 families on board to be expelled on each flight, meaning at least 6,000 people were “laterally expelled” in one month. Despite the use of these lateral expulsions, in April a total of 64% of families were allowed to seek asylum in the United States, up from 60% in March and 51% in February. This number rose again in May even though fewer families came to the border, with 77.9% of families apprehended by the Border Patrol allowed to seek asylum rather than being expelled. In June, that rose again to 83.9%.

    As the Biden administration continues to expel families back to Mexico, it cannot be forgotten that seeking asylum is legal...and can only be obtained by being on American soil.

    On the veracity of those claims

    PolitiFact found there is no definitive answer available since there are different categories of migrants being tested at different times and by varying groups across the border.

    But back in March, the head of the Federal Emergency Management Agency told lawmakers that the positivity rates for people coming across the border at the time was less than 6%. For some comparison, the average positivity rate in Texas was above 7% at that time.

    On testing migrants for COVID-19 and who is doing it

    Immigration authorities said they are working with state and local authorities and non-governmental groups to make sure that all migrants are tested “at some point during their immigration journey.”

    Federal health officials say that the many unaccompanied minors who have arrived are tested every three days — those who test positive are isolated from the rest.

    Customs and Border Protection personnel do initial checks for symptoms, and they consult with onsite medical staff. People who are presumed to be sick are sent to local health systems for testing, diagnosis and treatment, according to immigration officials.

    Cities, counties and nonprofits handle the vast majority of the testing and any subsequent isolation.

    On the work of nonprofit groups

    One example of what nonprofits do is the Jewish Family Service of San Diego. They help asylum-seekers reunite with their families in California and around the country.

    They told PolitiFact that many of these people who have had to remain in Mexico are being tested for COVID-19 in that country. Then they are tested again in the United States and remain in hotel rooms while awaiting results.
