The Insurrection Act of 1807 is a United States federal law[1] that empowers the President of the United States to deploy U.S. military and federalized National Guard troops within the United States in particular circumstances, such as to suppress civil disorder, insurrection, or rebellion.
The act provides a "statutory exception" to the Posse Comitatus Act of 1878, which limits the use of military personnel under federal command for law enforcement purposes within the United States.[2][3]
Before invoking the powers under the Act, 10 U.S.C. § 254 requires the President to first publish a proclamation ordering the insurgents to disperse. As part of the Posse Comitatus Act of 1878, these provisions are now codified as amended.
There are Constitutional exceptions to Posse Comitatus restrictions rooted in the President's own constitutional authority. Defense Department guidelines describe "homeland defense" as a "constitutional exception" to Posse Comitatus restriction, meaning that measures necessary to guarantee National Security from external threats are not subject to the same limitations.

Treason Clause
Article III, Section 3, Clause 1:

On 1-6. America faced the biggest threat to it continuing to exist since the war of 1812. It was an insurrection and sedition. The rightys were attacking the capitol with the intention of destroying it and killing politicians. This can not be whitewashed. Defending destroying the country by whatever lame and twisted excuses they can conjure, does not change it from the serious incident it was. I am not sure they can be punished too severely. This was a terrible thing to do to America.
This sentence gives away the motives of the writer: "The Constitution, as goofy and jerry-rigged as it is, stipulates that insurrectionists who violate their oath are not allowed to serve in Congress."
He claims to be a defender of democracy but doesn't seem to think highly of the Constitution overall. It makes one wonder what would be his ideal doctrine for "democracy."
You really think the mostly unarmed protesters were the "biggest threat" to our system since 1812? Hell, we'd be so lucky to have a government that easy to remove. These Q types are little more than the patsies for pushing more federal control over society.
I wouldn't necessarily have a problem with a more authoritarian system if our elites weren't so utterly contemptible. Authoritarian systems with more respectable elites can actually function well (like Singapore and Japan), but America's elite are among the worst in the West.
