12 years is the recommended min, and prosecution has already told the court that they expect a lot more than 12 years to be the result. 40 is the max.

Normally, in most states, a conviction will be returned for the most serious charge on which the jury can agree.

Our federal system is in my opinion absurd. 50 states. 50 different sets of felony statutes.

I believe they are called lessor included offenses. Basically, the same actions can be multiple crimes. The lessor crimes can be considered in an upward departure, but my guess is the more important aggravating circumstance here is that Chauvin was in uniform when he committed the crime, and that he committed the crime in front of children. He is looking at 12.5 years with no upward departures, but it could go as high as 40 years. There is a slight chance of a downward departure, but even the defense does not think that is possible. He will have to serve two thirds of that before a possible parole, so he will be spending between 8 and 30 years in prison. If I had to bet, I would say 8, but who knows.

Even eight years in prison is a horrific experience, I'm sure. He's being kept isolated to avoid the publicity of his being killed in prison.
