    we are talking about the generalities of the motion for mistrial.......I have watched none of this trial and make no comment on what has occured therein......

    If I felt I had likely won my case, I would not ask for a mistrial. I might fail to preserve an issue for appeal, but its a calculated risk.

    He made some comments during the final rebuttal that the defense objected to and asked for (I think) a mistrial based on prosecutorial misconduct. The Judge denied the request based on the fact that he instructed the jurors to disregard the prosecutor's improper comments.

    Just one more grounds for appeal if Chauvin is convicted.

    I don't think either side feels like they won their case.

    The jury could go either way or not even reach a verdict.

    A defense lawyer's duty is to try to do everything legally in his power to get his client off.

    Either via acquittal or by getting the charges against him dropped or by getting the case thrown out or by having a mistrial declared over any perceived, possible misstep by the state and holding their feet to the fire.

    It has nothing to do with "being afraid they lost".
