    True, but that action must be based on some constitutional power if the government exercises that power or passes a law enabling it.

    Many things not in the document are not powers the government exercises. Something not in the Constitution (creation of the National Bank under Washington) was still based on a constitutional power--the necessary and proper clause.

    I suspect the interstate commerce clause would be used for rents; or, the courts could rule it unconstitutional.

    Rents definitely existed in 1787 when the Constitution was drafted (not 1776, as Nerdberg ignorantly stated, although rents existed then, too.), and a federal judge has already ruled that CDC's moratorium is unconstitutional.

    Seems like some here do not grasp the fact that the moratorium on evictions was passed by congress and trump, Biden only extended it. By the way the current Relief Bill has money in there for both renters and landlords. I would also remind everyone that a Federal Judge in a lower court does not have the final say on the matter.

    i dont see any interstate commerce with eviction and rent freezes
    Although they used the Commerce Clause to justify the Obama individual mandate -so anything is possible

    Years ago the Supreme Court ruled it includes anything that "affects" interstate commerce. That justified federal New Deal legislation that regulated how much of his own grain a farmer could feed his pigs. It was also used as justification for the federal law against marijuana because a little old lady using pot in her own home affected the market price. It also allowed federal regulation over the six-toed cats on Hemingway's property in Key West.

    I think the SC rejected the government's claim that the commerce clause allows the mandate but was constitutional as a tax.
