    Default Trump lawyers argue in a brief, as they deny incitement

    In a 78-page brief submitted to the Senate, the former president’s lawyers took a two-track approach. They asserted that Mr. Trump’s speech just before the attack “did not direct anyone to commit unlawful actions,” and that he deserved no blame for the conduct of a “small group of criminals” who rioted at the Capitol after he had urged them to “fight like hell” against his election loss. They also insisted that the Senate “lacks jurisdiction” to try him at all because he was now a private citizen, calling such an effort “patently ridiculous.”

    A source familiar with the discussions said the trial will open with a four-hour debate and then a vote on whether the proceedings are unconstitutional because Trump is no longer president. The trial will then feature up to 32 hours of debate beginning on Wednesday at noon, the source added.

    Two problems, the actual speech was only the finale of Trump’s attempt to invalidate a lawful election that led to the events of January 6th, it all began back in the Fall and culminated on that date

    And secondly, Trump wasn’t a private citizen when he was impeached, and to dismiss his actions would be saying that any President isn’t responsible for what he does in his last month in office

    The very fact that Trump refused to admit he lost is why impeachment applies to the last days of the presidency.
