    Having the trial AFTER he leaves office will in fact be challenged in court for its Constitutionality.

    Whether he wins or not I do not know, but the trial will have to wait for the Supremes to weigh in first.

    My thinking is the 5 conservatives will point out how Unconstitutional it is, as the very idea of impeachment versus criminal courts is to REMOVE an official from office.

    If the judicial system wants to file charges against "citizen trump" then they should do so. Am all for it. Make the case, file the charges, and have it out in court. That's the way things are supposed to work.

    If the only point of this proposed "after he's gone" impeachment is to make sure Trump can't run for office in the future then the Congress can just make a rule/law that convicted felons can't run for president...and then convict him of a felony.


    It's all political showboating.

    Why Trump Can Be Convicted Even as an Ex-President

    Article II, Section 4 of the Constitution provides that the “President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.”

    But Article I, Section 3 says more. In describing the powers of the Senate to conduct an impeachment trial, it provides that “Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under the United States” (emphasis added).
