Don't get your hopes up. Of the cases the SCOTUS has seen from the 3rd circuit it has reversed the 3rd circuit 68.9 percent of the time. No lower court or even an appeals court wants to decide a case like this. Its like a hot potato that they are clearly happy to pass up the line to the SCOTUS. They want to be appointed to an appeals court or if they are already on an appeals court they want to be considered for the SCOTUS. Now the SCOTUS don't have to worry about a promotion.
