Here is where you are going off the rails. The judge is actually ruling on neither the case, nor the plea. The judge is ruling on your competency. If you are crazy, you cannot enter a guilty plea.

If the defendant refuses to plead not guilty, a judge can enter the plea on his behalf, but there must be a pleading of not guilty. So in a case where there is a pleading of guilty, no trial is ever started, much less over. You have plead guilty in the arraignment, and everyone is moving past the trial on to the sentencing. There is no trial.

No, that makes her guilty of lying to federal agents. Her case involved insider trading, while Flynn's case involved treason. Stewart was almost certainly guilty of the insider trading that she was attempting to cover up, and Flynn is almost certainly guilty of treason.

The fact remains Flynn lied about his contacts with Russia, and was a conduit of collusion. Whether that rises to the level of treason is more difficult to prove.

I really don't think the Supreme Court could find a Constitutional right to lie to the FBI about treason. Flynn definitely had the right to keep his mouth shut, but not to try to deceive the FBI.

But if you think I am wrong, Flynn can reject the pardon and try to take this case to the Supreme Court. It was a common trick to try to pardon civil rights defendants in the hope of preserving the unconstitutional law. It is important to turn down such pardons.

no guilt accepted. Pardons also include a "reprieve" (art.1 Sec 2) which this is since Flynn was never found guilty.
