In a jury trial, it is the jury who rules guilty, not the judge. But most people prison never get that far. They plea bargain, so are not convicted. Flynn has decided to go that route, but in an odd way. He has a pardon offered, so he knows by effectively pleading guilty he does not need to be punished.

He can refuse the pardon, and go to trial. He would probably be convicted then. He definitely lied to the FBI.

When he effectively pleads guilty, there is no need for a trial, nor a verdict by either a judge or a jury.

It is something like 98% of people incarcerated have not had a guilty verdict. Plea bargains are the major part of the legal system. If you were right, we would literally have to open up the prisons, and let most of the criminals out.

Flynn took an NSA job . During vetting, he lied about being a foreign agent, several times. He was taking big bucks from foreign nations. That is disqualifying.
He was found guilty of lying to the FBI a couple of times. He admitted in court, twice, that he lied to the FBI. This is traitorous.
Trump was warned about Flynn and that he was likely compromised. Obama told him "do not hire Flynn. Yates told trump he was compromised,. He thanked her by firing her.
Flynn is a damn criminal, which Is why Trump likes him. That and Trumps loyalty fixation.
Accepting the pardon is tantamount to a confession. This was a very bad pardon, but likely more are coming. There is so much to coverup.

Flynn took money from the government of Turkey to write editorials and lobby for them. Flynn refused to registered as foreign agent and lied to FBI when asked. Flynn is a traitor to the US.

He (gasp) wrote editorials and lobbied for a NATO ally , got paid for his work, didn't register as a foreign agent and lied to the FBI about it in casual company , not under oath? He should be shot.
