Yes, these are federal laws and agencies. There are a lot of federal agencies that are unconstitutional. The States, however, have so far chosen to ignore this. That doesn't make them constitutional of course, but it does mean the States do support these agencies. They do have that right to do so.

If people have a gripe about this, they can go to their State government and impose a change. This is effectively how marijuana laws have been getting passed, how definition of marriage laws have been getting passed, and how several other State laws that nullify these federal laws or agencies get passed.

Nothing compels any State, after all, to follow an unconstitutional law or an unconstitutionally created agency.
