That is called brandishing a weapon or communicating a threat. Assault requires you physically injure another party. In Missouri you can use a firearm in defense of your property and life. The mob broke into their property through a locked gate, destroying the gate, and flooded on to the property ignoring No Trespassing / Private Property signs POSTED. That is breaking and entering, a felony. They according to Ken and Barbie communicated threats of violence. The couple called 911--there will be a recording of that call to tell police they were in fear for their lives and what was happening. That they picked up firearms and brandished them to drive the mob off without shooting anyone is well within the self-defense laws of the state they are in. They didn't leave their property, didn't pursue anyone.
The mob stopped approaching them, but clearly were not frightened and running away from them either. Instead, we can see on video that they engaged both in a series of verbal shouting matches. No assault was present.
The DA is so hit in trying to prosecute this it is funny. This will be expensive for the city and state.
