If we were running out of National Guard, I could understand trying to suspend the Posse Comitatus Act. We are nowhere near there.
But, I am not very concerned about this yet. trump likes to waste taxpayer money on his fantasies which he never executes. Remember his fantasy about suspending the Constitution and declaring martial law in Chicago. Nothing ever came of that other than some wasting of taxpayer money.
I am far more concern about trump's calls for genocide and mass rebellion. Some of his less stable supporters are going to kill people in acts of terrorism because of his calls for violence.

It is a law under the Constitution. trump says he has the right to disregard the laws, because of his interpretation of the Constitution. That interpretation is no one else's.

Though his actions would better be described as irresponsibly lazy. This still leaves open the danger, and even absolute certainty, that his less stable supporters will kill Americans.

He's anxious to literally pull the trigger on doing so. It will be interesting to see how America votes after the government shooting a dozen or more American citizens.The Posse Comitatus Act, 18 U.S. Code, Section 1385, an original intent of which was to end the use of federal troops to police state elections in former Confederate states, proscribes the role of the Army and Air Force in executing civil laws and states:

It is completely legal for trump to talk about declaring martial law, and it is also legal for him to waste money on having troops on alert for declaring martial law. He just is very limited in being able to actually declare martial law.
I am hoping this ends like most of his threats to attack the constitution, in nothing but a waste of time and money.
Well sort of... trump is setting the stage for a future president having a coup. trump is normalizing the language of a coup.
