    because they can be proven, you dumbass. hate to break it to you but the mob doesn't get to decide what is charged. First degree murder requries the state to prove an ACTUAL INTENT to KILL. They also need to have malice aforethought. It would be very hard for the state to prove that he decided he actually wanted to kill george vs. acting recklessly or arrogantly or thinking he'd be fine.

    manslaughter is acting recklessly that results in a death without a specific intent, which is much easier to prove in court.
