    Default The U.S. Constitution Needs Another Term

    in the White House just to survive liberalism.

    Thankfully, five of the Nifty Nine got started when they handed down a good one:

    Tuesday's outcome also is certain to doom a lawsuit filed by the parents of a teenager killed in Nogales, Mexico, from gunshots fired across the border by a U.S. agent. That case has been on hold.

    The case tested a half-century-old Supreme Court decision that allows people to sue federal officials for constitutional violations. Over the years, the courts have made it harder to bring claims, known as Bivens actions after the name of the high court case.

    Naturally, the American Civil Liberties Union’s lawyer on the High Court dissented:


    Ginsburg wrote that “it is all too apparent that to redress injuries like the one suffered here, it is Bivens or nothing. I resist the conclusion that ‘nothing’ is the answer required in this case."

    I never knew that federal judges were allowed to define principles! I always thought judges were supposed to defend Rights spelled out in the written Constitution. In any event illegal aliens have no constitutional Right to be here; so deporting them posthaste cannot possibly deprive them of a constitutional liberty granted by the ACLU.

    Note that Norman Thomas founded the National Civil Liberties Bureau during WW I which morphed into the ACLU in 1920. Roger Baldwin, one of the ACLU’s founders, and its first director, laid out the ACLU’s judicial philosophy for all time irrespective of the ACLU barring Communists from leadership and staff positions in 1940. Basically, Baldwin realized that controlling the courts was more important in the long run than was keeping a few easily-identified Communists on the ACLU’s payroll.

    I am for socialism, disarmament, and, ultimately, for abolishing the state itself... I seek the social ownership of property, the abolition of the propertied class, and the sole control of those who produce wealth. Communism is the goal.

    A sharply divided Supreme Court also upheld the death sentence for an Arizona inmate who was convicted of killing two people in home burglaries nearly 30 years ago.

    Justice Brett Kavanaugh, writing for the court’s conservative justices, rejected the arguments of inmate James Erin McKinney that he deserved a new sentencing hearing so that a jury can decide whether he should face death or life in prison.

    He was first sentenced to death by a judge.

    The court’s four liberal justices dissented.

    Rights do not come from a constitution. Constitutions define and declare governments and specify what authorities and powers they have. They may also act as a contract between the owners of the that constitution. The owners of the U.S. Constitution are the States.

    We don't shoot illegal Mexicans. We send them back to Mexico.

    Illegally crossing the border is a felony. Shooting a fleeing felon is authorized. Shooting in self defense is also authorized.

    (3) Liberal hero Paul Wellstone—an actual progressive Democrat—gave a speech on the Senate floor calling this dump “environmental racism.” Former Texas Democratic Rep. Silvestre Reyes called Sanders actions “insanely callous.”

    (4) After Congress approved the proposal, environmental regulators rejected the Sierra Blanca site. But a different site in Andrews County, Texas gained approval a few years later and Vermont/Texas maintain an interstate waste agreement.

    (5) In 2016, Sanders’ tax returns revealed that as of 2014 Jane Sanders was still drawing a small salary as an alternate commissioner for the Texas Low-Level Radioactive Waste Disposal Compact Commission as part of the agreement with Vermont that her husband pushed.

    This story is, well, toxic. Bernie drew up an environmentally-controversial proposal to dump nuclear waste in a Latino community, then refused to meet with the people it impacted. Oh, and he managed to secure a little sweetheart deal to enrich his wife in the process. Funneling public and campaign money to his spouse (no stranger to financial scandal) has been something of a pastime for this socialist, who was a jobless deadbeat before becoming a career politician who is now a millionaire with three homes. This episode is problematic for Bernie on the subjects ranging from environment, to race, to his "man of the people" persona, to graft. And as Miller notes, it makes for a hell of an ad -- and this 15-second spot barely hits the basics:

    Of what virus are you talking about? No virus is striking the country in catastrophic ways.

    Martial law won't fix or even limit a viral outbreak.
