The issue is not whether something is hurting anyone or offending anyone.
It must meet the constitutional test of having (government action) a legitimate secular purpose. A historical rendering of the 10 commandments meets the test if it is within a larger historical contest. Just putting a plaque in a courthouse of the 10 commandments has no secular purpose. Requiring kids in a (public) school to recite a prayer is not hurting anyone, but it has no secular purpose so it unconstitutional.

Jewish law does not consider the fetus to be a being with a soul until it is born. It does not have personhood. Furthermore, before 40 days, some poskim, or deciders of Jewish law, have a low bar for allowing an abortion.
The Talmud, in Yevamos 69b, cites the view of Rav Hisda that “until forty days from conception the fetus is merely water. It is not yet considered a living being.”
If there is a threat to a woman’s life, the safety of the mother takes precedence over continuing the pregnancy at any stage. Many sources illustrate this graphically and rather unambiguously, and all modern poskim, or religious decisors, agree on this. In fact, in certain circumstances, a fetus that endangers the life of the mother is legally considered a “murderer” in active pursuit.
The greater priority is the health and welfare of the mother. “Jewish law sees the fetus during the first 40 days of gestation as ‘simply water’ and during the rest of gestation ‘like the thigh of its mother.’ It does not become a full human being until birth, specifically, until the head emerges from the vaginal canal or, if a breach birth, when ‘the majority of the body’ or the shoulders emerge,” said Rabbi Analia Bortz, co-founder of Congregation Or Hadash. Bortz is also a medical doctor with post-doctorate studies in bioethics.
