So when Dershowitz says Pelosi and the Democrats are doing considerable damage to the impeachment process and the constitution—in their efforts to undo an election, Democrats won’t be able to claim he’s a closet Trump supporter.

What’s not to like about it?
That's a crock of bullshit. He's trying to claim Trump is not his client, when in fact, he is part of his defense. Lying old fuck.

Sorry but "Abuse of Power" ( 'maladministration' as Madison called it) isn't impeachable -
nor is withholding the aid but releasing it before the end of the fical year an "impoundment" by POTUS

    "Obstruction of Congress" is laughable
    ~~
that's about what he's been saying
"Maladministration" isn't in the Constitution and Madison lost that wording and that argument. At the time, "high crimes and misdemeanors" didn't mean a criminal offense and Dershowitz knows it.

no he didn't "lose the argument" - it's not impeachable, and it's not in the Constitution! how could he "lose?"

The Constitution is specific, and one should not even look at Federalist papers, and certainly not back to English common law.

We have the text /the text is clear only "crimes" are impeachable. -every other discussion is just noise
The text is the sole authority

Not really, but I understand why that sounds pleasing to you. We already know that the Senate trial is rigged: McConnell and Graham have made no bones about "working closely with the White House" and doing everything possible to obstruct witnesses and other fact-gathering. Let's pretend that their shriveled souls are suddenly awakened and they decide to play it right. Even in the face of overwhelming evidence, the (R)s are unlikely to vote to remove TRE45ON for partisan reasons. We know this going in, so it's not going to be a big surprise when it happens.

The big surprise will wait till November.

Dersh is a believer in the imperial presidency. He is perfect for offering that . Most Reds believe Trump can do whatever he wants. Trump believes it too. His interpretation of the Constitution is getting ripped by constitutional scholars. He is 81. This is his last shot on the big stage. https://www.lawfareblog.com/alan-der...t-impeachments Dershowitz will present a flawed and wrong opinion according to real scholars.

High crimes and misdemeanors" was the wording chosen instead of "maladministration", because the latter was considered too vague and would subject the President to be serving at the whim of the Senate. Mason offered the new wording and it was accepted with the additional wording "against the United States". The revision committee somehow lost those last 4 words, which helps to clarify the true meaning.

    Repeat for the illiterates:

At the time of the writing, the TEXT "high crimes and misdemeanors" DID NOT necessarily mean criminal offenses. You're trying to insert today's text into the meaning of the text 250 years ago.

The president has enough lawyers. Dershowitz is a learned advocate for defending the Constitution. He has already spoken to the attempt by the Democrats to shred that document. He is a liberal who actually believes that the Constitution protects all Americans, left and middle and right.

He will make the Blue team look like children.

Meanwhile, McConnell, Nunez and the rest of those howling jackass repugnants in the House have made the Red Team look not only like children, but petulant, diaper shitting babies.

doesn't matter -the words aren't in the Constitution - the TEXT is the ONLY authority

Actually, whim of Congress. It's a dual process, idiot.

You haven't a clue what the TEXT, as written meant. That's obvious.

The meaning of the TEXT: "

"those offences which proceed from the misconduct of public men, or in other words from the abuse or violation of some public trust. They are of a nature which may with peculiar propriety be denominated political, as they relate chiefly to injuries done immediately to the society itself.” (Federalist 65)

Where does it state criminal offenses?

    Moron.

Trump* hired a friend in common with Episten, someone he likely has dirt in. Dershowitz claims he kept his undies on while getting massages from underage girls! Hahaha! Birds of a feather!
